These General Terms and Conditions of Sale consolidate two distinct sets of terms, applicable depending on the type of product purchased on the Jamel Gems website:
Section A – Online Courses: terms applicable to the purchase of gemology training courses.
Section B – Physical Products: terms applicable to the purchase of jewelry and gemstones.
Each section applies exclusively to the relevant product type.
The Customer acknowledges that it is their responsibility to consult the section corresponding to the purchased product.
By confirming their order and checking the acceptance box provided for this purpose, the Customer acknowledges that they have read all of these General Terms and Conditions of Sale, including both sections, and accept them unreservedly for the category or categories of products included in their purchase.

1. ACCEPTANCE OF TERMS
Please read these General Terms and Conditions of Sale carefully.
By purchasing a course offered by Jamel Gems, you (hereinafter referred to as “the Customer”) acknowledge that you have read these General Terms and Conditions of Sale and accept them without reservation.
These terms constitute a legal contract between the Customer and Jamel Gems and define the rights and obligations of both parties regarding the purchase and use of the online gemology courses offered.

Sales of jewelry and gemstones are subject to separate General Terms and Conditions of Sale, available on the relevant pages.
These terms do not replace or modify the terms applicable to physical products.
4. COURSE DESCRIPTION
The courses offered consist of educational digital content, accessible online after payment has been confirmed.
They aim to provide practical skills, including:
Identification of gemstones
Gemological analysis
Evaluation
Purchasing, investing, and resale
The courses may include demonstrations and explanations using professional instruments such as:
Gemological loupe
Refractometer
Spectroscope
Other analytical tools
The content is provided for educational and training purposes only.
5. COURSE ACCESS – LIFETIME ACCESS
Access to the courses is granted for life, meaning as long as the Jamel Gems platform and the relevant courses remain online.
This notion of “lifetime access” does not constitute a guarantee of perpetual accessibility independent of the site’s existence, operations, or technical decisions of Jamel Gems.
In the event of force majeure, cessation of activity, or significant changes to the services, access to the courses may be interrupted without entitlement to compensation or refund.
6. INTERNAL COMPETENCY CERTIFICATE
Upon completion of certain courses, an internal competency certificate may be issued automatically after passing the final exam.
This certificate:
Is issued exclusively by Jamel Gems
Serves as an internal record of course completion and competency level
Is not an official diploma
Is not recognized by any accredited laboratory, public institution, or regulatory authority
Does not confer any legal or regulatory authorization to practice a profession
Any professional use of acquired skills, including commercial resale to third parties, is the sole responsibility of the Customer.
7. NO GUARANTEE OF RESULTS AND LIABILITY
The courses offered do not constitute financial advice, investment advice, or a guarantee of profit.
No financial, professional, or commercial result is guaranteed.
Performance and outcomes depend in particular on the Customer’s personal involvement, experience, and decisions.
Purchasing, investing, reselling, or professional use decisions made after taking the course are the sole responsibility of the Customer.
Jamel Gems cannot be held liable for:
Financial losses
Evaluation errors
Business decisions
Any direct or indirect consequences resulting from the use of the knowledge acquired
8. RIGHT OF WITHDRAWAL AND REFUND POLICY
In accordance with the provisions relating to digital content under the Consumer Code:
8.1 Orders with immediate access
When the training is accessible immediately after payment, the Customer expressly acknowledges:
that the performance of the service begins as soon as the payment is validated,
that immediate access to the digital content is provided,
and that they expressly waive their right of withdrawal.
No refund may be granted once access to the content has been activated.
8.2 Pre-orders
In the case of a pre-order, no access to the digital content is provided at the time of payment.
The training will be delivered at a later date specified on the website.
The Customer has a legal period of 14 days to exercise their right of withdrawal and request the cancellation and refund of their pre-order, provided that access to the content has not yet been granted.
From the moment the training is effectively made available and access is activated, the Customer waives their right of withdrawal and no refund may be granted.
9. INTELLECTUAL PROPERTY
All course content (videos, texts, materials, methods, visuals) is protected under intellectual property law.
Any reproduction, distribution, sharing, resale, or exploitation, in whole or in part, without prior written permission is strictly prohibited.
10. FRAUDULENT BEHAVIOR, DEFAMATION, AND PENALTIES
In the event of:
Fraudulent sharing of access
Hacking or attempts to bypass security systems
Illegal distribution of content
Proven acts of defamation
Jamel Gems reserves the right to:
Suspend or permanently revoke access to the courses
Take any appropriate legal action
Without any possibility of refund or compensation
Honest feedback and constructive criticism remain permitted.
11. PERSONAL DATA
The Customer’s personal data is processed in accordance with applicable regulations and solely within the context of the commercial and educational relationship.
12. GOVERNING LAW AND JURISDICTION
These General Terms and Conditions of Sale are governed by French law.
Any dispute regarding their interpretation or execution falls under the exclusive jurisdiction of French courts.

These General Terms and Conditions of Sale (hereinafter “GTC”) apply exclusively to the sale of physical products (jewelry and precious stones) offered by JAMEL GEMS.
Online courses offered on the site are subject to separate terms, gathered in a distinct section of the same document.
1. ACCEPTANCE OF TERMS
By placing an order with JAMEL GEMS, the Customer (hereinafter “the Customer”) acknowledges that they have read, understood, and accept these GTC without reservation.
These GTC constitute a legal contract between the Customer and JAMEL GEMS, and prevail over any other version, verbal exchange, or prior document.

3. SCOPE OF APPLICATION
These GTC apply to all sales of physical products made by JAMEL GEMS, whether the sale is:

Remote
In-person (hand delivery)
They apply to both consumers and professionals, unless special written conditions have been expressly agreed upon by JAMEL GEMS.
4. PRODUCTS
JAMEL GEMS offers carefully selected jewelry, gems, and precious stones.
Descriptions may include, for reference: weight, dimensions, color, purity, cut, origin, or gemological characteristics.
4.1 Nature of the Stones
The stones offered are natural unless explicitly stated otherwise.
Natural stones may exhibit intrinsic variations (inclusions, color nuances, texture), which do not constitute defects or non-compliance.
4.2 Photographs and Descriptions
Photographs, videos, and descriptions are provided for illustrative purposes.
Minor variations due to photography, lighting, or natural characteristics of the product may exist and are expressly accepted by the Customer.
4.3 Certification
Unless explicitly stated in writing, the products sold are not systematically accompanied by an independent laboratory certificate.
5. PRICES
Prices displayed on the site or communicated via message or email are indicative and subject to availability.
The price becomes firm, final, and contractual only after an invoice is issued by JAMEL GEMS.
Products remain the exclusive property of JAMEL GEMS until full payment of the invoiced price.
6. ORDERS
An order is considered final only after:
Confirmation by JAMEL GEMS
Receipt and clearance of full payment
JAMEL GEMS reserves the right to refuse any order without justification.
7. PAYMENT TERMS
7.1 Hand Delivery
Payment must be made in full via bank transfer or online payment prior to the appointment.
No product will be delivered before effective payment.
7.2 Online Orders
Online orders are payable in full using the methods offered on the site.
Shipping occurs only after full payment has been received.
The invoice issued by JAMEL GEMS constitutes the only valid contractual document.
8. DEPOSITS AND TRAVEL
For any appointment requiring travel (within France or internationally), a non-refundable deposit may be required to cover incurred expenses.
If the Customer cancels, the deposit remains with JAMEL GEMS.
If JAMEL GEMS cancels, the deposit will be refunded or deferred at the Customer’s choice.
9. DELIVERY – TRANSFER OF RISK
Delivery is carried out either:
By hand
Or via secure transport
The transfer of risk (loss, theft, damage) occurs upon delivery of the product to the Customer.
10. RIGHT OF WITHDRAWAL
10.1 Online Orders
In accordance with the law, the Customer has a 14-day right of withdrawal from the date of receipt of the product.
The product must be returned intact, unused, in its original packaging, accompanied by the invoice.
10.2 Exclusion
Sales completed in person (hand delivery) are final and not subject to withdrawal.
11. VAT AND TAXES
VAT not applicable – Article 293 B of the French CGI.
Any customs duties or local taxes are the sole responsibility of the Customer.
12. NO GUARANTEE OF INVESTMENT OR RESALE
Products sold by JAMEL GEMS do not constitute investment advice.
JAMEL GEMS does not guarantee any potential appreciation, resale value, or future profitability.
Any resale or professional/commercial use is the sole responsibility of the Customer.
13. LIMITED LIABILITY
JAMEL GEMS cannot be held responsible for:
Improper or altered use of the product
Poor maintenance
Export-related consequences
Any direct or indirect financial loss
14. INTELLECTUAL PROPERTY
Any unauthorized reproduction, use, or distribution of content, images, or descriptions is strictly prohibited and may lead to legal action.
15. GOVERNING LAW – JURISDICTION
These GTC are governed by French law.
In case of dispute, exclusive jurisdiction is assigned to the courts of the location of JAMEL GEMS’s head office, unless mandatory legal provisions state otherwise.
